DECISION TO DECLINE REVIEW OF ADMINISTRATIVE LAW JUDGE DECISION

This case is before the Departmental Appeals Board (DAB) on a notice of appeal filed by Joe Eideh d/b/a 7-Eleven 34428 (Respondent).  Respondent appealed a November 15, 2019 Administrative Law Judge (ALJ) initial decision, Joe Eideh d/b/a 7-Eleven 34428, DAB TB4511 (2019).  In that decision, the ALJ imposed a $17,115 civil money penalty for selling a tobacco product while under a No-Tobacco-Sale Order, in violation of 21 U.S.C. § 331(oo).

After considering each of the contentions made by Respondent in its appeal and examining the record, we have decided to decline review of the ALJ’s initial decision.  See 21 C.F.R. § 17.47(j).  Thus, the ALJ’s initial decision becomes final and binding 30 days after this declination.  Id.
