DETERMINATION TO DECLINE REVIEW OF ADMINISTRATIVE LAW JUDGE'S DISMISSAL

On April 17, 2020, Petitioner Paige M. Aletti filed with the Departmental Appeals Board an appeal of the ruling of the administrative law judge (ALJ), Paige M. Aletti, Dismissal, ALJ Ruling No. 2020-9 (April 13, 2020).  The ALJ dismissed Petitioner's request for hearing as untimely filed, in accordance with 42 C.F.R. § 1005.2(e)(1) ("The ALJ will dismiss a hearing request where . . .  [t]he petitioner's . . . hearing request is not filed in a timely manner[.]").

After reviewing Petitioner's appeal and the record on which the ALJ issued his Dismissal, we have determined that we need not render a separate decision.  Pursuant to 42 C.F.R. § 1005.21(g), we decline review of and summarily affirm the ALJ's Dismissal.
