DECISION DISMISSING WITHDRAWN COMPLAINT

On January 25, 2023, the parties filed a joint motion to dismiss the aggrieved party’s request for review of Local Coverage Determination (LCD) L34074.  The joint motion satisfies the requirements of 42 C.F.R. § 426.423(c)(1).  The aggrieved party is advised in accordance with 42 C.F.R. § 426.423(c)(1) that she may not file another complaint related to the same coverage determination for six months.  The parties are advised that pursuant to 42 C.F.R. § 426.465(d)(2), this dismissal decision is not subject to further review by the Departmental Appeals Board.  The LCD complaint is dismissed pursuant to 42 C.F.R. § 426.444(b)(7).
