(f) If nonconforming supplies or services are discovered after acceptance, the defect appears to be the contractor’s fault, any warranty has expired, and there are no other contractual remedies, the contracting officer—
- (1) Must notify the contractor in writing of the nonconforming supplies or services;
- (2) Must request that the contractor repair or replace the supplies, or perform the services, at no cost to the Government; and
- (3) May accept consideration if offered.

Obtain warranties for technical data when practicable and cost effective. Use the factors in FAR 46.703 to decide whether to require a warranty. Consider these factors when deciding whether to use extended liability provisions—
(1) Whether correcting or replacing the nonconforming data, or providing a price adjustment, adequately protects the Government; and
(2) Whether extended liability would better deter the contractor from providing nonconforming data.]
