OGC supports the development and implementation of the Department’s programs by providing the highest quality legal services to the Secretary of HHS and the organization’s various agencies and divisions. The Office of the General Counsel (OGC) at the Department of Health and Human Services is seeking an attorney to join its General Law Division (GLD), Procurement, Fiscal and Information Law Branch (PFIL). GLD provides general legal support to the entire department in the primary practice areas of procurement, fiscal, information, claims, and employment law.

Duties:
This is an opening for a Technology Law attorney. The attorney will advise agency officials, program managers, and IT/security personnel on legal issues involving emerging technologies, including artificial intelligence (AI), data governance, and cybersecurity. It will also advise on legal implications of federal and departmental initiatives related to AI governance, AI adoption and use, AI risk management, and federal AI policy. The attorney will also provide counsel on cybersecurity authorities and requirements, including compliance with the Federal Information Security Modernization Act (FISMA), Executive Orders, OMB directives, and relevant HHS and federal cybersecurity policies. The attorney must also support incident response activities by advising on breach notification requirements, risk assessment processes, law enforcement coordination, and associated legal considerations and counsel clients on data access, use, and governance, including coordination with other attorneys within HHS on regulatory requirements, especially as they apply to modern technologies and data-driven programs; Review and advise on proposed technology-related agreements, transactions, memoranda of understanding, data-sharing arrangements, terms & conditions, and other instruments addressing technology governance, data authorizations and restrictions, information security, confidentiality, system access, and Enterprise IT investment, capital planning, and portfolio oversight. The attorney will provide legal review of technology procurement strategies and documentation, including issues related to licensing, cloud services, cybersecurity controls, and AI system acquisition, prepare legal opinions, memoranda, and briefing materials, and represent the agency in internal groups, regulatory development efforts, and policy discussions involving technology and cybersecurity. Familiarity with federal information law, privacy law, HHS regulatory domains, procurement law, and intellectual property law are all desirable. Other duties will include advising agency officials on other general and administrative law topics. Familiarity with other general law areas (e.g., federal appropriations law and federal information law) is desirable.
We are seeking to fill the positions at the GS-15 level ($147,945 - $192,331) depending on experience and qualifications.
The positions will be located in Washington, D.C.; Baltimore, MD; Philadelphia, PA; Atlanta, GA; Kansas City, MO; Denver, CO; Chicago, IL, depending on section assignment. Reimbursement for relocation expenses is not available.

Salary will be commensurate with education and experience. Applicants should have four (4) years of experience post bar admission specifically in technology law. One year of the four years of government technology law experience must be at a level equivalent to the GS-14 level.

GS-15: Applicants at the GS-15 level must have at least four years of professional legal experience, one of which must have been at the GS-14 level. Applicants at the GS-15 level must also have a demonstrated ability to work independently with minimum levels of supervision.
Conditions of Employment:
- You must possess a Juris Doctorate (J.D.) from an accredited ABA law school.
- Proof that bar status is active, in good standing and eligible to practice in the highest court of a State, U. S. commonwealth, U. S. territory, or the District of Columbia.
- Candidates must also have exemplary legal writing, oral advocacy abilities, possess excellent interpersonal skills, and displays a capacity to work with diverse individuals and groups.
- Must maintain active bar membership in good standing and the eligibility to practice law in the highest court of a state, territory, Commonwealth, or the District of Columbia throughout employment in the Office of the General Counsel.
- Upon final job offer from HHS OHR, the successful candidate must submit official law school transcripts.
- Security and Background Requirements: If not previously completed, a background security investigation will be required for all appointees. Appointment will be subject to the applicant's successful completion of a background security investigation and favorable adjudication. Failure to successfully meet these requirements may be grounds for appropriate personnel action.
