Treatment of Recovered Cost-Sharing Reduction Amounts in the Medical Loss Ratio and Rebate Calculations
This draft bulletin clarifies how issuers should include in their MLR and rebate calculations the CSR amounts for prior benefit years recovered as a result of the recent court decisions. The draft bulletin would also permit certain modifications to the standard notices that would be required to accompany additional rebates sent to enrollees that an issuer may owe as a result of including recovered CSR amounts.
