Question: Can employers participating in the Federally-facilitated Small Business Health Options Program (FF-SHOP) offer the same plan to employees who work out of state as the plan offered to in-state employees?

Answer: Yes, an employer may offer the same plan to employees who work out of State as the plan offered to in-state employees. An employer with employees working in more than one State has two options: 1) Cover all employees from the State in which the employer has its main business, or 2) Cover the employees through the SHOP in each state using the primary business address in that state.
