MLN8990453 - New Domestic N95 Respirator Payment Adjustments

This revised Product comprises Subregulatory Guidance for new payment adjustments to hospitals for their share of the additional costs of domestic National Institute for Occupational Safety and Health (NIOSH)-approved surgical N95 respirators compared to non-domestic respirators, and its content is based on publically available content within CY 2023 final rule at https://www.govinfo.gov/content/pkg/FR-2022-11-23/pdf/2022-23918.pdf. CMS policy or operation subject matter experts also reviewed/cleared this product. This product explains who can request the payments adjustments, how to request the payment adjustments, why Medicare is doing payment adjustments and what’s the effective date. CMS finalized these payment adjustments to help sustain a level of domestic supply resilience for surgical N95 respirators that’s critical to protect the health and safety of personnel and patients in case of future pandemic or increase in transmissions of COVID-19.
