ACA Financial Appeals (ACA FA) FAQ

Guidance for FAQ regarding Request for Reconsideration and Timing

Final

Issued by: Centers for Medicare & Medicaid Services (CMS)

Issue Date: July 22, 2016

Program Area: ACA Financial Appeals (ACA FA)

Question: Can the Centers for Medicare & Medicaid Services (CMS) clarify whether the August 29, 2016 submission deadline requires issuers to submit all discrepancies and appeals or submit the Cost-sharing Reduction (CSR) Reconciliation Request for Reconsideration Web Form?

Answer: CMS is aware that the deadline to submit the Request for Reconsideration Web Form and discrepancies overlap. CMS recommends issuers to submit both the Request for Reconsideration Web Form and discrepancies at the same time. However, if an issuer determines that the submitted discrepancy is resolved, then the issuer can withdraw the Request for Reconsideration Web Form.
