Guidance for FAQ regarding Employer/Employee Interaction and Minimum Participation Rate

Question: Does the 11/15-12/15 minimum participation rate waiver apply to off-Marketplace plans? Does it apply to standalone dental plans in FF-SHOPs?
Answer: Issuers both inside and outside the SHOP are not allowed to impose a minimum participation rate from 11/15 through 12/15. These rules do not apply to standalone dental plans in FF-SHOPs because they provide excepted benefits.
