Question: Does the Mental Health parity requirement apply to both SHOP and individual markets?
Answer: Yes, all EHB plans must include mental health and substance use disorder services and those must comply with parity. Per 45 CFR 156.115(a)(3), since EHB plans are sold in the small group and individual markets, that means parity is required in both markets.
