Making Facilities & Programs Accessible for Persons with Disabilities

OCR enforces:

  • Section 504 of the Rehabilitation Act of 1973, 29 U.S.C. § 794 – ensures that people with disabilities have equal access to programs, services, activities, and facilities that receive Federal financial assistance
  • Title II of the Americans with Disabilities Act of 1990, 42 U.S.C. § 12131 et seq. – ensures that state and local governments, including those that receive no Federal financial assistance, provide people with disabilities equal access to their programs, services, activities, and facilities

Regulations

  • 45 C.F.R. Part 84:  Nondiscrimination on the Basis of Handicap in Programs or Activities Receiving Federal Financial Assistance.
  • 28 C.F.R. Part 35:  Nondiscrimination on the Basis of Disability in State and Local Government Services.
