The Oregon Department of Human Resources appealed a decision by the
Health Care Financing Administration disallowing $393,891 in federal
financial participation (FFP) under Title XIX (Medicaid) of the Social
Security Act.  The State claimed FFP for January 1 through September 30,
1985 for certain personnel costs based on the availability of an
enhanced FFP rate of 75% for compensation and training of skilled
professional medical personnel and support staff.  The Agency disallowed
the portion of the State's claims which exceeded the 50% rate generally
applicable to administrative costs for the Medicaid program.  In Oregon
Department of Human Resources, Decision No. 729, March 20, 1986, the
Board determined the allowability of the enhanced rate of FFP for 56
individual positions involved in the administration of the Medicaid
program covering 35 different job titles for October 1, 1981 through
December 31, 1984.  The State asserted that there are no issues unique
to the current appeal, and the Agency agreed that Decision No. 729
should control the outcome here.

Accordingly, for the reasons stated in Decision No. 729, which is
incorporated here by reference, we uphold in part and overturn in part
the disallowance.  We conclude from the parties' submissions that they
will take the findings both on general issues and specific positions in
Decision No. 729 and decide which positions in the later time period can
be reimbursed at the enhanced FFP rate.
