The New Jersey Department of Human Services appealed a decision by
the Health Care Financing Administration disallowing $1,723,272 in
federal financial participation claimed by the State under Title XIX of
the Social Security Act. The claim, included on the State's expenditure
report for the quarter ended September 30, 1983, was for inpatient
psychiatric services provided to individuals between the ages of 22 and
64. The services were rendered during the month the individual was
admitted to or discharged from an institution for mental diseases, or
during the month after the month of admission.

In its notice of appeal, the State indicated that this appeal
involves the same issue as that decided by the Board in Joint
Consideration: IMD Admission/Discharge Issue, Decision No. 436, May 31,
1983. The parties agreed that separate proceedings in this case were
unnecessary and that the Board should proceed to decision based on the
parties' presentations in the cases leading to Decision No. 436.
Accordingly, for the reasons stated in Decision No. 436, which is
incorporated here by reference, we uphold this disallowance of
$1,723,272 subject to reduction under the same conditions as the
disallowances in Decision No. 436.
