The New Jersey Department of Human Services appealed two decisions by
the Health Care Financing Administration disallowing a total of
$1,076,194 in federal financial participation claimed by the State under
Title XIX of the Social Security Act. The claims, included on the
State's expenditure reports for the quarters ended March 31, 1983
(Docket No. 83-278) and June 30, 1983 (Docket No. 83-276) were for
inpatient psychiatric services provided to individuals between the ages
of 22 and 64. The services were rendered during the month the
individual was admitted to or discharged from an institution for mental
diseases, or during the month after the month of admission.

In its notices of appeal, the State indicated that these appeals
involve the issue previously decided by the Board in Joint
Consideration: IMD Admission/Discharge Issue, Decision No. 436, May 31,
1983. The Board consulted with the parties, who agreed that separate
proceedings in these cases were unnecessary and that the Board should
proceed to decision based on the parties' presentations in the cases
leading to Decision No. 436. Accordingly, for the reasons stated in
Decision No. 436, which is incorporated here by reference, we uphold the
disallowance of an additional $1,076,194, subject to reduction under the
same conditions as the disallowances in Decision No. 436.
