Title IV-F of the Social Security Act

Background:

The provision of PRWORA cited above authorizes grants to Indian tribes and Alaska Native organizations that conducted JOBS programs in fiscal year 1995 under title IV-F of the Social Security Act.  The purpose of the new grant is to operate a program to make work activities available to members of the Indian tribe.

Currently, 76 Indian tribes, consortia of Indian tribes and Alaska Native organizations conduct JOBS programs.  These Tribal JOBS programs are being conducted according to plans submitted or the period October 1, 1994 through September 30, 1997.

Purpose:

The purpose of this Program Instruction is to provide revised guidance to Indian tribes and Alaska Native organizations, regarding the effective date for the new grant program, when new grant awards will be issued and how Tribal JOBS grantees will be funded in the interim period.  This information supersedes the information provided in TANF-ACF-PI-96-1, dated September 16, 1996.

Policy:

Section 116(a)(1) of Title I of PRWORA states that the effective date for the provisions in title I of PRWORA is July 1, 1997.  Section 116(b)(1) does provide for an accelerated effective date.  However, it has been determined that section 1116(b)(1) is not applicable to Indian tribes and Alaska Native organizations. Therefore, the effective date for the new grant program authorized by section 412(a)(2) of the Social Security Act, as amended by PRWORA, is July 1, 1997.

Fiscal Year 1997 JOBS grants were issued to Tribes on November 13, 1996.  Tribal grantees will have until June 30, 21997 to obligate these JOBS funds; obligations must be liquidated by September 30, 1998.  The obligation period for FY 1997 JOBS awards will end June 30, 1997 because Title IV-F of the Social Security Act, the Authority under which these funds are issued, is repealed as of that date.  All grantees will be required to complete and submit an SF-269a 90 days after the obligation period of June 30, 1997.  The final SF-269a is due 90 days after the liquidation period of September 30, 1998.

Federal funding will be available July 1, 1997 for the new grant program authorized under section 412(a)(2) of the Act, as amended by PRWORA.  The amount of each grantee's award will be equal to the amount of the grantee's JOBS allocation in fiscal year 1994.  Grantees will have until June 30, 1998 to obligate these funds; obligations will need to be liquidated by June 30, 1999.  Section 412(a)(2) grant awards will be issued annually on July 1 in future fiscal years.
