Extension of Limited Non-Enforcement Policy through 2023 and Later Benefit Years 

CMS announced in November 2013 that issuers could choose to continue certain non-grandfathered health insurance coverage in the individual and small group markets that could not otherwise remain in place without significant changes to comply with ACA requirements (also known as ‘grandmothered’ plans). CMS has continuously extended this limited non-enforcement policy since then. This bulletin further extends CMS’ limited non-enforcement policy through calendar year 2023 and will remain in effect until CMS announces that such coverage must come into compliance with specified requirements
