EEO Compliance and Operations

Department of Health & Human Services (HHS) employees are protected by the Civil Rights Act of 1964 as amended, and other federal laws, regulations, directives, and policies prohibiting discrimination and harassment on the basis of:

  • race
  • color
  • religion
  • sex (including sexual harassment, pregnancy, gender identity and sexual orientation, and pay)
  • national origin
  • age (40 years of age or over)
  • disability (physical or mental)
  • genetic information or family medical history
  • reprisal (retaliation)

These protections extend to management practices and decisions, including, but not limited to, recruitment and hiring practices, appraisal systems, promotions, and training.  If you believe you have been discriminated against in one or more ways listed above, you must contact the appropriate Equal Employment Opportunity (EEO) office listed below within 45 calendar days of the alleged discriminatory action.

The HHS, Office of the Secretary (OS), Office of the Assistant Secretary for Administration (ASA), Equal Employment Opportunity Compliance and Operations (EEOCO) Division administers and ensures compliance with the laws, regulations, policies, and guidance that prohibit discrimination in the federal workplace for employees and applicants.

HHS EEO Offices encourage resolution and require processing of EEO informal and formal complaints in accordance with applicable federal EEO laws and regulations. 

The HHS OS/ASA EEOCO and the OPDIVs also process EEO complaints from Commissioned Corps in accordance with Instruction 6, CC26.1.
